Sundown Chase Rules and Regulations apply to all Occupants, Renters, and Guests. If you have any questions or concerns, please fill out the contact page form, and the HOA president will get back with you.
- Occupancy
- According the Garrett County Maryland Municipality, the maximum occupancy for a Transient Vacation Rental Unit (TVRU) is two people per bedroom, plus four additional people. Our three bedroom units allow up to 10 occupants and our four bedroom units allow up to 12 occupants when being rented. Maryland has no statewide occupancy law, so for permanent residents, that would fall under the 2-1 federal rule which is 2 per bedroom plus one additional occupant. Permanent owner occupants are therefore limited to no more than 7 permanent occupants in the our three bedroom units and no more than 9 permanent occupants in our four bedroom units.
- Common Grounds remain free of trash and debris
- All common grounds including, but not limited to, the parking lot, walkways, stairwells, utility sheds, garden beds, and lawn must remain trash and debris free. A large trash dumpster and recycling bin are located in the southwest corner of our community, close to the road, across from building one. Please dispose of all trash and debris to the dumpster at all times. Please keep the fencing door closed when disposing trash. Violations are subject to county fines, please clean up after yourself and your guests at all times!
- Parking
- The parking lot contains one space per bedroom. If you have a four bedroom, there are four spaces available, if you have a three bedroom, there are three spaces available. No additional use of parking spaces permitted. No car washing or car repairs permitted. These parking rules apply to all occupants, renters, and guests. There are three parallel spaces for boats, vessels, trailers or over-sized trucks along the parking lot closest to Deep Creek drive. These spaces are for use by reservation only on a first come-first serve basis. To reserve one of these spaces, please fill out the contact form on this website, and we will get back to you quickly.
- Noise Ordinance
- Quiet hours are 11pm-7am weekdays, and 12am-8am on weekends. This includes no music or videos playing on outside decks, and no audible sound from anyone's interior should be heard by anyone outside or within their own units. Violations may be reported on the contact page of this website 24/7, thank you.
- Decks and Hot Tubs
- Noise Ordinance hours applies to use of Decks and Hot tubs. Rented units MUST have Hot Tub Rules signage posted for all guests and tenants. Hot Tub maintenance crews must use caution not to spill water to units below or in areas that will puddle. Hot tub users must also use caution not to spill water on Decks below or any shared common area. No towels or clothes drying on railings or anywhere on Decks and Hot Tubs, keep your towels indoors. All Hot Tubs must have secured covers in place at all times when not in use. No bird feeders, wind chimes, or windmills of any kind permitted on Decks. Flags may be raised on Deck and entry door railings under state and federal flag guidelines and only two flags per unit are permitted. Deck lighting is permitted as long as it does not interfere or create light pollution to anyone else's exterior or interior space
- Dogs and Pets
- Dogs and Pets are permitted at Sundown Chase. Individual Owners who rent decide on their own Pet Policy. Dogs and Pets must be supervised outdoors, including on Decks, by an adult at all times while on Sundown Chase property. All pet waste is to be cleaned up immediately and placed in the community trash dumpster at all times, violations will fall under Garrett County, MD leash laws to be observed at all times.
- Grills and Firepits
- Grills, smokers and gas powered fire pits are permitted on Deck and exterior spaces. Wood fire and/or combustion firepits of any kind are NOT permitted anywhere in Sundown Chase Community. Fireworks are illegal in the state of Maryland and fireworks are NOT permitted in Sundown Chase Community.
- Exterior Maintenance Policy
- Exterior buildings and grounds maintenance are managed and executed by the HOA board and property management in place. No exterior building alterations may be made by any unit owners/renters/guests, no exceptions. No grounds, lawn, parking lot, or Deck structure alterations may be made by any unit owners/renters/guests, no exceptions. Unit owners may apply for permission to install storm doors on the unit front door if plausible, as well as electronic or manual awnings on Decks that are plausible. Each application is reviewed, and approved or declined, by the four Board members in place.
- Reporting Leaks or Damages
- Owners, renters, and guests are all obligated at all times to report any possible or observed water leaks in and among units. Other emergency damages required to be reported include anything observed in roofing or exterior architecture materials including gutters and downspouts, drainage, and utility lines. lastly, any pest infestation observed must also be reported to HOA management. - Water shut-off and Thermostat requirements
- All owners, renters and guests are required to shut off the unit's main water valve when leaving the property to be vacant for 24 hours or more. If you believe your unit is vacant or going to be vacant with the water still on, please send a message on the contact form of this website so property management may access your unit and turn the water off. There are no exceptions to this rule and lack of this action by any unit owner, renter or guests will negate Management insurance towards your unit. Heating Thermostats are required to be set at a minimum of 62 degrees at all times during cold weather months. Remote or wifi thermostats are strongly recommended so you may monitor your unit's heating and cooling while not present. If you feel you are having a heating or cooling emergency, you must report that to the HOA property management, please use the contact us form on this website.
- Renters
- All association, county and local municipality rules and regulations apply to all renters and guests staying in Sundown Chase Units. Any renters or guests that are reported and/or observed to be breaking any rules or regulations will be required to forfeit any reservation and associated monies and will be required to leave immediately.
The Sundown Chase Rules and Regulations above are required to be delivered to all renters and guests of unit owners at Sundown Chase during each individual reservation. A link to this page is recommended as well as a signed acknowledgment from each contracted renter. These rules and regulations are considered part of the Sundown Chase Community By-Laws.
